The Office of the State Fire Marshal (OSFM) requires a distributors or wholesalers of ground-based sparklers permit for the sale of approved sparklers, ground-based sparklers, and novelty items to the public by distributors or wholesalers.
Information and documentation needed to apply
- Applicant’s full name, business name, addresses and phone numbers
- If applying as a partnership, information must be completed for each member.
- If an association or corporation, the information must be completed for each officer and / or director.
- Type of business: Individual, partnership, association, corporation
- A list of all Maryland addresses where products will be stored and sold
- A complete list of products intended for sale
- Samples for each product item
- Any product update, new product, or addition to the product line occurring during your registration period must be submitted before sale. Samples of updated or new products must be submitted immediately and before being offered for sale.
- A copy of a current OSFM inspection report for the business premises
- If this is a renewal application, include an updated product list and samples (if applicable)
Local government restrictions
Ground-based sparklers are prohibited in the following jurisdictions:
- Full Fireworks Bans: Baltimore City, Montgomery County, and Prince George's County.
- Ground-Based Sparkler Bans: Ocean City, Harford County, and Howard County.
Required sparkler inspection
Before the sale, offering for sale, or use of any sparkler within the State, the manufacturer must submit sufficient samples to the OSFM for inspection. These samples must be accompanied by a laboratory report from a certified testing facility confirming that the sparklers contain no chlorates or perchlorates.

Application processing time
